Selling part of your garden for development

In shortPart of a large garden can be sold for one or more new homes if there is a way in from the road, enough width for a house with space round it and no planning constraint that forbids it. Combining with a neighbour often turns a maybe into a yes. The sale of part of your main home's garden is usually free of capital gains tax, but take advice.

Garden land is the easiest development land to overlook because its owner lives on it. A long garden behind a house on a village street, a side plot wide enough for a house, a corner where two gardens meet: each is looked at by the planning system as land inside the settlement, where the principle of homes is already accepted.

What makes it work

  • A way in. A drive from the road to the back, at least four and a half metres wide. Or a frontage wide enough for a new house.
  • Room. A plot of about a third of an acre for one house, more for two, with the new homes not overlooking the old ones unreasonably.
  • No forbidding constraint. A conservation area or a protected tree does not stop it; a flood zone or an Article 4 direction can.
  • Neighbours. Two or three gardens together can take a small cul de sac. The owners share the uplift and none of them loses a view.

Tax

The sale of part of the garden of your main home is normally within the private residence relief from capital gains tax, provided the garden is of a size appropriate to the house and the sale happens while you still live there. Can I sell part of my garden for a house?
Often, if there is a way in from the road, room for a house with space round it and no constraint that forbids it. Land inside a settlement already has the principle of housing accepted, so the questions are practical ones.
Do I pay capital gains tax on selling my garden?
Usually not, where it is part of the garden of your main home, of an appropriate size and sold while you still live there. Sell the house first and the relief is lost. Take professional advice.
How wide does the access need to be?
For one or two homes, a drive of about four and a half metres plus visibility at the road. For more, highway standards apply and we check them in the first ten days.
